Regular Meeting
June 2, 2009
Call to Order. A regular meeting of the Stafford County Board of Supervisors was called to order by George H. Schwartz, Chairman, at 1:02 P. M., Tuesday, June 2, 2009, in the Board Chambers, Stafford County Administration Center.
Roll Call. The following members were present: George H. Schwartz, Chairman; Cord A. Sterling; Robert “Bob” Woodson; M. S. “Joe” Brito Harry E. Crisp II, Vice Chairman, and Mark Dudenhefer. Paul Milde arrived at 1:05 P. M.
Also in attendance were: Anthony Romanello, County Administrator; Joe Howard, County Attorney and Marty Beard, Chief Deputy Clerk.

Item 3. Finance and Budget; Approve Expenditure Listing.
Resolution R09-238 reads as follows:
A RESOLUTION TO APPROVE EXPENDITURE LISTING
(EL) DATED MAY 19, 2009 THROUGH JUNE 1, 2009
WHEREAS, the Board has appropriated funds to be expended for the purchase of goods and services in accordance with an approved budget; and
WHEREAS, the payments appearing on the above-referenced Listing of Expenditures represent payment of $100,000 and greater for the purchase of goods and/or services which are within the appropriated amounts;
NOW, THEREFORE, BE IT RESOLVED by the Stafford County Board of Supervisors on this the 2nd day of June 2009, that the above-mentioned EL be and it hereby is approved.
Item 7. Finance and Budget; Approve Quarterly Payments for Acquisition of England Run Library Opening Collection.
Resolution R09-242 reads as follows:
A RESOLUTION TO APPROVE QUARTERLY PAYMENTS FOR THE ACQUISITION OF THE ENGLAND RUN LIBRARY OPENING DAY COLLECTION
WHEREAS, the Board approved the construction of the England Run Library which is expect to be completed in late summer or early fall 2010; and
WHEREAS, the acquisition of the opening day collection takes approximately one year; and
WHEREAS, funds for the purchase of the opening day collection are included in the estimated project costs; and
WHEREAS, the Board wishes to demonstrate its support for the Central Rappahannock Regional Library in this difficult economic climate;
NOW, THEREFORE, BE IT RESOLVED by the Stafford County Board of Supervisors on this the 2nd day of June, 2009, that the County Administrator be and he hereby is authorized to make a payment not to exceed Two Hundred Fifty Thousand Dollars ($250,000) each calendar quarter, beginning July 1, 2009 and ending December 1, 2010, to the Central Rappahannock Regional Library for the acquisition of the opening day collection for the England Run Library; and
BE IT FURTHER RESOLVED that the release of payments be contingent on review of the project to ensure that it remains within the total estimated project cost of $11,052,491.
Item 8. Legislative; Appoint Members to Boards, Authorities, Commissions and Committees.
Resolution R09-246 reads as follows:

WHEREAS, the Board and the City of Fredericksburg, have executed an Operations Contract for Regional Landfill; and
WHEREAS, the Contract provides for the appointment of two members of the Board to be appointed as members of the Rappahannock Regional Solid Waste Management Board to serve with two members of City Council, the County Administrator, and the City Manager; and

Resolution R09-241 reads as follows:
A RESOLUTION APPROVING AN AGREEMENT OF CONVEYANCE
FOR THE PURCHASE OF A PORTION OF PARCEL 43-77A FOR THE ROCKY PEN RUN RESERVOIR
WHEREAS, Resolution R04-237 authorized the County Administrator to enter into contracts for the purchase of certain properties for Rocky Pen Run Reservoir; and
WHEREAS, it is in the County’s interest to acquire the 2.278 acre portion of Parcel 43-77A required for the reservoir; and
WHEREAS, the County’s offer to purchase this property owned by Jerry P. and Sandra E. Nini for the amount of $301,200 was accepted by the property owners; and
WHEREAS, Board approval is required for the purchase of this property;
NOW, THEREFORE, BE IT RESOLVED by the Stafford County Board of Supervisors on this the 2nd day of June, 2009, that the County Administrator be and he hereby is authorized to execute the Agreement of Conveyance between the Board of Supervisors of Stafford County and Jerry P. and Sandra E. Nini, regarding TM 43-77A in the amount of Three Hundred One Thousand Two Hundred Dollars ($301,200); and
BE IT FURTHER RESOLVED that the County Administrator be and he hereby is authorized to execute all documents necessary to close on the above-referenced property.
Public Works; Approve the FY2010 Potomac and Rappahannock Transportation Commission Administrative Fee and Virginia Railway Express Subsidy and Authorize Payment. The County Administrator gave a presentation and responded to Board members questions.
Mr. Woodson motioned, seconded by Mr. Milde, to adopt proposed Resolution R09-231.

Mr. Sterling made a substitute motion, seconded by Mr. Dudenhefer, to adopt proposed Resolution R09-231 minus $434,000 that is going towards subsidizing the other communities.

Resolution R09-231 reads as follows:
A RESOLUTION TO APPROVE AND AUTHORIZE PAYMENT OF
THE FY2010 POTOMAC AND RAPPAHANNOCK TRANSPORTATION COMMISSION ADMINISTRATIVE FEE AND THE VIRGINIA
RAILWAY EXPRESS SUBSIDY
WHEREAS, the County is a member of the Potomac and Rappahannock Transportation Commission (PRTC); and
WHEREAS, the County is a participating jurisdiction of the Virginia Railway Express (VRE); and
WHEREAS, the County’s FY2010 PRTC administrative fee is $52,200; and
WHEREAS, the County’s FY2010 VRE subsidy is $2,971,727;
NOW, THEREFORE, BE IT RESOLVED by the Stafford County Board of Supervisors on this the 2nd day of June, 2009, that the Board be and it hereby does approve the proposed PRTC and VRE subsidies as stated above; and
BE IT FURTHER RESOLVED that the payment of the subsidies during FY2010 be and they hereby are authorized.
Administration; Presentation on Development Services Changes and Improvements. Mr. Michael Neuhard, Deputy County Administrator, gave a presentation and responded to Board members questions.
Mr. Jeff Harvey, Director of Planning and Zoning, and Mr. Keith Dayton, Director of Public Works, were also available to respond to Board members questions.
Finance and Budget; Presentation on FY2009 Budget Update. Ms. Nancy Collins, Budget Director, gave a presentation and responded to Board members questions.
Scott Mayausky, Commissioner of the Revenue, commented further.
Legislative; Discuss Tax Collection Zip Codes. Mr. Milde commented.
Scott Mayausky, Commissioner of Revenue, Tim Baroody, Deputy County Administrator, and David Gayle, Assistant Director of Legislative Affairs, responded to Board members questions.
Hearing no objections from the Board, staff was requested to arrange for a representative of the Post Office to address this issue in late summer.
Legislative; Discuss Board of Zoning Appeals Legal Counsel Funding. Mr. Joseph Howard, County Attorney, gave a presentation.
Discussion ensued.
Mr. Brito motioned, seconded by Mr. Crisp, to provide $14,000 from contingency reserve.
Discussion further ensued.
Mr. Brito amended the motion, Mr. Crisp seconded the amended motion, to indicate that the funding will only be used to advise the Board of Zoning Appeals at meetings and on agenda issues only.

Planning and Zoning; Amend Section 28-38, Performance Regulations of the Zoning Ordinance. Mr. Jeff Harvey, Director of Planning and Zoning, gave a presentation and responded to Board members questions.

Mr. Brito motioned, seconded by Mr. Crisp, to request that the County Attorney bring back proposed Ordinance O09-09 with three changes (1) buildable area square footage, 8,000 sq. ft; (2) allow exemptions for family subdivisions; (3) define horizontal distance as 100 sq. ft.

Mr. Milde made a motion, seconded by Mr. Dudenhefer, to deny proposed Ordinance O09-09.
Mr. Brito made a substitute motion, seconded by Mr. Crisp, to defer proposed Ordinance O09-09 until after the Comprehensive Plan and Draft Cluster Development for agricultural zonings have been presented to the Board in the August timeframe.

WHEREAS, the Stafford County Board of Supervisors desires to consult with counsel and discuss in Closed Meeting Discussion regarding Potential Business or Industry Economic Development Prospect Where No Public Announcement has been Made; Legal Advice regarding the Use of Rescue 1 Building; Pending Litigation, Service District Cases, Nageotte v. Board of Supervisors and D.S.A.M. v. Board of Supervisors; and the Comprehensive Plan Advertisement and Related Issues; and one Personnel Matter regarding the County Administrator’s Annual Evaluation; and
WHEREAS, pursuant to Section 2.2-3711 A.7, A.5 and A.1, Va. Code Ann., such discussions may occur in Closed Meeting;
NOW, THEREFORE, BE IT RESOLVED that the Stafford County Board of Supervisors; on this the 2nd day of June, 2009, does hereby authorize discussions of the aforestated matters in Closed Meeting.

A RESOLUTION TO CERTIFY THE ACTIONS OF THE STAFFORD COUNTY BOARD OF SUPERVISORS IN A CLOSED MEETING ON JUNE 2, 2009
WHEREAS, the Board has, on this the 2nd day of June, 2009, adjourned into a closed meeting in accordance with a formal vote of the Board and in accordance with the provisions of the Virginia Freedom of Information Act; and
WHEREAS, the Virginia Freedom of Information Act, as it became effective July 1, 1989, provides for certification that such Closed Meeting was conducted in conformity with law;
NOW, THEREFORE, BE IT RESOLVED that the Stafford County Board of Supervisors does hereby certify, on this the 2nd day of June, 2009, that to the best of each member's knowledge: (1) only public business matters lawfully exempted from open meeting requirements under the Virginia Freedom of Information Act were discussed in the Closed Meeting to which this certification applies; and (2) only such public business matters as were identified in the Motion by which the said Closed Meeting was convened were heard, discussed, or considered by the Board. Legislative; Comprehensive Plan. Mr. Crisp motioned, seconded by Mr. Brito, that the Board authorizes the proposed Comprehensive Plan be advertised for joint public hearing with the Planning Commission and it be amended to clarify the language with a text change as presented this date concerning the ‘Projected 2019 Phased Urban Service Area Expansion’.

A RESOLUTION TO AMEND THE EMPLOYMENT AGREEMENT
WITH THE COUNTY ADMINISTRATOR
WHEREAS, the County Employees received a cost-of-living increase of 1.2% on January 1, 2009; and
WHEREAS, the County Administrator’s salary has not changed since January 1, 2008; and
WHEREAS, the Board desires to increase the County Administrator’s salary consistent with other County employees;
NOW, THEREFORE, BE IT RESOLVED by the Stafford County Board of Supervisors on this the 2nd day of June, 2009 that the Employment Agreement for the County Administrator be and it hereby is amended as follows:

An increase of 1.2% shall be included in salary beginning January 1, 2009 to Employment Agreement expiration.

WHEREAS, the Board has carefully considered the recommendation of the Planning Commission, staff and testimony at the public hearing; and

Conditional Use Permits, Rezonings and BZA Variances, Special Exceptions and Appeals:
If an application is withdrawn prior to the first public hearing, fifty (50) percent of the amount of the application fee may be refunded to the applicant.
If an application is withdrawn after the first public hearing, the application fee is non-refundable.
Plan and Plat Applications:
If an application is withdrawn prior to the completion of the first review, fifty (50) percent of the total fee amount paid will be refunded.

BE IT FURTHER ORDAINED that this ordinance shall take effect on July 6, 2009; and

AN ORDINANCE TO AMEND BUILDING AND LAND DEVELOPMENT INSPECTION FEES PROVIDED BY THE DEPARTMENTS OF PUBLIC WORKS, FIRE AND RESCUE, AND PLANNING AND ZONING
WHEREAS, the Board is authorized by the Code of Virginia to set reasonable fees for building and land development inspection services provided by the Departments of Public Works, Fire and Rescue, and Planning and Zoning; and
WHEREAS, the Board acknowledges that the fees for these services should be kept current with the actual costs of providing services; and
WHEREAS, building and land development inspection fees were last adjusted with the FY2009 Budget; and
WHEREAS, the Board desires to set fees for building and land development inspection services commensurate with the FY2010 costs of providing these services;
NOW, THEREFORE, BE IT ORDAINED by the Stafford County Board of Supervisors on this the 2nd day of June, 2009, that the schedule of fees for building and land development inspection services listed below and provided by the Departments of Public Works, Fire and Rescue, and Planning and Zoning be and they hereby are amended and reordained as follows:

R09-248 until after the revisions to the Comprehensive Plan and appropriate amendments to the text can be drafted.

A RESOLUTION TO REFER AMENDMENTS TO THE ZONING AND SUBDIVISION ORDINANCE TO THE PLANNING COMMISSION REGARDING THE ESTABLISHMENT OF TIME LIMITS FOR PLANS
WHEREAS, there is no incentive or requirement for developers to pursue continual activity on plan applications under review; and
WHEREAS, plan applications submitted for review can remain active indefinitely if there has been no activity or resubmission of plan by the developer; and
WHEREAS, plan applications under review for several years must begin the review process each time an ordinance is amended; and
WHEREAS, neither the Subdivision nor the Zoning Ordinance regulates the time between completion of the county review and resubmission of plans; and
WHEREAS, the Board desires to regulate the time between completion of the county review and resubmission of plans; and
WHEREAS, public necessity, convenience, general welfare and good zoning and subdivision practices require adoption of the proposed amendment;
NOW, THEREFORE, BE IT RESOLVED by the Stafford County Board of Supervisors on this the 2nd day of June, 2009, that the amendments to the Zoning and Subdivision Ordinances by proposed Ordinance O09-34 be and they hereby are referred to the Planning Commission for its consideration; and
BE IT FURTHER RESOLVED that the Planning Commission be and it hereby is authorized to make appropriate amendments to proposed Ordinance O09-34 as it deems necessary.

Mr. Brito motioned to have the County Attorney revise this ordinance, proposed Ordinance O09-09, and bring to the Board at the next Board meeting amending the ordinance to decrease the buildable lot area from 10,000 sq. ft. to 8,000 sq. ft. and to allow a provision that family subdivisions are exempt and to define the horizontal distance – change it from 25 ft. to 100 ft.
